End User License Agreements, EULA
Programming code is software that makes a website or a computer program function. This unique code is the trademark of a developer. The programming code for a website is usually not sold as part of the entire package. A developer may provide a EULA, an End User License Agreement to protect both the customer and the programmer as a simple arrangement.
Licensed Software
The purpose of a license is to assure the trademark of a programmer is protected and cannot be exchanged to a third party vendor without penalty. The EULA also benefits the customer with additional protection of using the derivative works performed by a professional software developer.
Perspectives
Which is more valuable, the code or the branding features? The branding features are more valuable to a client and the code is most valuable to the livelihood of a developer who holds exclusive rights to modify and reuse it. An agreement (EULA) protects both parties by stating who is responsible for the code that makes a software function. A customer must have exclusive rights to their branding features, trademark, slogans, and text. A EULA clarifies this agreement from both perspectives.
Expectations and Delivery
Retainer fees, balances, and totals for all transactions must accompany receipts that may used for tax deductible benefits. Copyright laws allow ancillary and related areas of venue to be due to the administrator of derivative works. Licensing for copyright material is retained by the creator unless signed agreements are made in advance. Total payment assures that a client receives the high-quality service expected in a B2B relationship. |

All productions are protected by U.S. and International copyright laws without discretion for the lack of knowledge. In simple terms, individuals get sued for copyright infringement. Therefore, time consuming research is a valuable preventative step to avoid that.
Web designers, ghostwriters, and software developers are in their chosen field to sell thier work for money at a specified price. When agreed payments are exchanged for service, the derivative work is in the hands of the buyer. With all due respect, a painting, a sculpture, a poem, a manuscript, or an art will always be the creation of the artist's signature. Therefore, a EULA is requested in all due respect for individual copyrights.
